Terms of Service

How you can use XOBLACK and how disputes are resolved.

1. Agreeing to these terms

By creating an account or using XOBLACK you agree to these Terms of Service, including the arbitration agreement below. If you do not agree, do not use XOBLACK.

2. Arbitration agreement

Any dispute between you and XOBLACK that arises from or relates to these terms or your use of XOBLACK will be resolved by final and binding arbitration before a neutral arbitrator, and not in a court. There is no judge or jury in arbitration, and review of the arbitrator’s decision is limited.

3. No class actions

You and XOBLACK may bring claims against each other only on an individual basis, and not as a plaintiff or class member in any class, collective or representative action. The arbitrator may not combine more than one person’s claims.

4. What is not covered

Either of us may bring an individual claim in small-claims court. This agreement does not apply to any claim that the law does not allow to be arbitrated, including claims of sexual assault or sexual harassment where you choose to go to court.

5. Opting out

You can opt out of this arbitration agreement within 30 days of creating your account by emailing the XOBLACK support team with your username and the words “opt out of arbitration”. Opting out does not affect any other part of these terms.
